Can Americans Buy Property in Mexico?
Yes. Americans can legally acquire real estate in Mexico. For residential property within the restricted coastal zone, foreign buyers commonly hold beneficial rights through a Mexican bank trust known as a fideicomiso.

The Restricted Zone and Fideicomiso
Mexico's Constitution limits direct foreign title within specified distances of coasts and borders. A fideicomiso allows a Mexican bank to hold title while the foreign beneficiary retains rights to use, lease, improve, sell and pass on the property, subject to the trust and applicable law.

Closing Is a Mexican Legal Process
A Mexican notary has a formal public-law role in the transfer, but does not replace independent buyer counsel. Title, liens, permits, taxes, condominium status and the identities and authority of the parties should be reviewed before funds are released.

Budget Beyond the Purchase Price
Acquisition taxes, notarial and registration costs, trust setup, professional fees and other charges vary by transaction. U.S. buyers should also obtain cross-border tax advice on ownership, rental income and eventual sale.
